What substantive law a judge or an arbitrator decides to apply can determine the outcome of the case. Yet there is little case law available.
This book aims to fill that gap by providing 101 previously unpublished decisions on the applicable substantive law. While these decisions are made by arbitrators and therefore not binding or guiding, they give insight as to what the most frequent choice of law issues are, how decision makers may reason in different situations, and where they can go wrong.
This collection of choice of law decisions is intended to be used in problem based courses in international private law and international commercial arbitration at universities in any country, but also by practitioners preparing a case where the choice of substantive law is unsettled.
The decisions are made available with the curtesy of the Arbitration Institute of the Stockholm Chamber of Commerce (SCC).
